Terms and Conditions

School of Applied Metaphysics (Pty) Ltd

These Terms & Conditions apply to the educational and professional training programmes offered by the School of Applied Metaphysics (Pty) Ltd through its website: https://schoolofappliedmetaphysics.com/our-study-journey


By applying for, enrolling in, or participating in a course, programme, workshop or training experience offered by the School, you confirm that you have read and accepted these Terms & Conditions.


1. About the School

The School of Applied Metaphysics provides structured education and professional training in metaphysics, emotional intelligence, mindfulness, conscious living, self-inquiry, coaching and related areas of personal and professional development.


The School also offers Heal Your Life® training in South Africa under the applicable Heal Your Life® licensing and authorisation arrangements.


Programmes are offered at different levels and may include theoretical learning, personal practice, practical application, mentoring, supervised practice, assessment and other learning activities according to the programme. Each programme is offered according to its published description, structure, duration, entry requirements and completion requirements.


2. Nature and Scope of the Training

The School's training is educational and developmental in nature.

The content may introduce learners to metaphysical principles, self-inquiry, emotional intelligence, mindfulness, conscious living, coaching, facilitation and related approaches.


Heal Your Life® training is delivered by the School under its applicable licensing and authorisation arrangements and remains subject to the requirements of the Heal Your Life® programme and its intellectual property protections.


Completion of a School programme does not qualify a person to diagnose or treat medical or psychological conditions, prescribe medication, or present themselves as a regulated healthcare professional unless they independently hold the qualifications and registration required to do so.

Learners and graduates remain responsible for practising within their own qualifications, competence, professional scope and applicable legal requirements.

3. Programme Information and Fair Representation

The School aims to provide clear and accurate information about each programme before enrolment, including where applicable:

  • the purpose and content of the programme;
  • the level of study;
  • duration and delivery format;
  • entry requirements;
  • practical and assessment requirements;
  • fees and payment arrangements; and
  • certification or completion requirements.

Programme information is intended to provide learners with a reasonable understanding of what is being offered before they enrol. Where a material change becomes necessary after enrolment, the School will communicate the change to affected learners as reasonably practicable.


4. Enrolment

Enrolment is subject to the requirements of the specific programme.

Where an application, prerequisite, assessment, interview or other entry requirement applies, enrolment is confirmed once the applicable requirements have been completed and accepted by the School.

The School may decline an application where programme requirements have not been met or where enrolment is otherwise not appropriate for the programme.


5. Programme Fees and Payment

The applicable programme fee will be displayed on the website or communicated to the learner before enrolment.


Where a payment plan or instalment arrangement is offered, the number and timing of payments, the amount payable and any applicable conditions will be communicated before enrolment and will form part of the enrolment agreement.


A payment plan is an arrangement for paying the agreed programme fee over the agreed period. It does not change the programme's learning, assessment or certification requirements.

The learner remains responsible for payments due under the agreed arrangement.


Where a payment is missed, the School may contact the learner to arrange continuation or resolution of the account. Continued access to a programme may be affected where fees remain unpaid, subject to the terms communicated for that programme and applicable law.


6. Course Access and Learning Materials

Access to online learning material, recordings, workbooks, assessments and other resources is provided according to the arrangements of the specific programme.

Access is provided to the enrolled learner only and may not be shared, transferred or made available to another person.

Where access is provided for a defined period, access may end when that period expires or when the programme arrangement otherwise concludes.


7. Participation and Completion

Learners are responsible for engaging with the learning material and completing the requirements of their chosen programme.

Where a programme includes attendance, practical hours, observations, case studies, assignments, assessments, supervised practice, a portfolio of evidence or other practical requirements, these form part of the completion requirements.

Completion is determined according to the requirements communicated for the specific programme.

Payment of programme fees alone does not constitute completion of a programme.


8. Assessment and Certification

Where assessment forms part of a programme, learners are required to complete the stated assessment requirements.

A certificate is issued only when the learner has completed the requirements applicable to that programme.

A School certificate confirms completion of the stated School training. It does not, by itself, constitute a government licence, statutory registration or regulated healthcare qualification unless specifically stated otherwise.

Where a programme leads to a particular level of School certification, the learner must meet the requirements applicable to that certification.


9. Professional and Ethical Conduct

The School is committed to maintaining respectful, ethical and professional learning environments.

Learners are expected to:

  • conduct themselves with integrity and respect;
  • maintain appropriate professional boundaries;
  • respect the dignity and privacy of others;
  • maintain confidentiality where required;
  • engage responsibly with trainers, mentors, fellow learners, clients, coachees and participants; and
  • practise only within their competence and stated scope.

Harassment, exploitation, discrimination, serious misconduct, deliberate misuse of School material, breaches of confidentiality or conduct that places another person at unreasonable risk may result in appropriate action, including suspension or removal from a programme.


10. Confidentiality

Personal information shared during training, practical sessions, mentoring, observations or other learning activities will be treated with care and confidentiality, subject to applicable law.

Learners are also responsible for protecting the confidentiality of information shared by other learners, clients, coachees or participants during their training.

Where practical learning involves real people, learners remain responsible for obtaining any permissions required for the use of information, recordings or case material and for protecting the identity and privacy of those involved.


11. Intellectual Property

The School's course content, written materials, presentations, exercises, assessments, workbooks, recordings, frameworks, methodologies and other educational resources are the intellectual property of the School or the applicable rights holder.

Enrolment provides permission for personal educational use of the materials supplied to the learner. It does not transfer ownership or intellectual-property rights.

School materials may not be copied, reproduced, distributed, published, resold, taught, licensed or commercially adapted without prior written permission.

Heal Your Life® materials, content, trademarks and programme methodology remain subject to the intellectual property and licensing requirements of the applicable rights holder.

 

12. Artificial Intelligence and Learning

The School recognises that learners may use artificial intelligence (AI) tools as part of their personal learning, research and study where appropriate.

AI may be used as a learning aid, but learners remain responsible for the accuracy, originality and integrity of their work.


Where an assignment, assessment, reflective exercise, practical submission or other programme requirement is intended to demonstrate the learner's own knowledge, understanding, reflection or professional competence, AI-generated work may not be presented as the learner's own work.

Learners remain responsible for checking and verifying information obtained through AI tools. AI-generated information may be inaccurate, incomplete or misleading and does not replace the learner's own learning, judgement or professional responsibility.


School course materials, assessments, recordings, workbooks, frameworks, methodologies and other proprietary content may not be uploaded to AI systems for the purpose of reproducing, redistributing, teaching, selling or commercially developing material derived from the School's intellectual property without prior written permission.


The same restriction applies to Heal Your Life® training materials, workbooks, recordings, programme content, methodologies and other intellectual property made available through the School under its licensing and authorisation arrangements.


Learners must not enter personal, confidential or identifying information relating to clients, coachees, fellow learners or other participants into an AI system without appropriate permission and a lawful basis for doing so. 

Where a particular programme or assessment has specific requirements regarding the use of AI, those requirements will be communicated as part of that programme and will apply to the relevant learning activity.


13. Cancellation, Withdrawal and Refunds

Cancellation, withdrawal and refund arrangements are set out in the School's Refund & Cancellation Policy.

Where a programme has specific cancellation or refund conditions, those conditions will be communicated before enrolment and will apply to that programme.

The School will handle cancellation and refund matters fairly and in accordance with applicable South African law.


14. Changes, Postponement or Cancellation by the School

The School may, where reasonably necessary, postpone, reschedule, modify the delivery method of, or cancel a programme due to circumstances such as trainer availability, insufficient enrolment, technical difficulties, emergencies or other circumstances beyond reasonable control.

Where reasonably practicable, affected learners will be informed and an alternative arrangement will be considered.

Where a programme is cancelled and cannot reasonably be rescheduled or replaced with an agreed alternative, any amount refundable will be dealt with in accordance with the programme's applicable terms and South African law.


15. Recognition of Prior Learning or Previous Training

Where a programme allows recognition of prior learning, previous study or relevant experience, any such recognition is subject to the School's stated requirements and assessment process.

Previous training or experience does not automatically entitle a learner to exemption from programme requirements unless confirmed by the School.


16. Privacy

Personal information collected in connection with applications, enrolment, training, assessments, communication, practical work and certification is handled in accordance with the School's Privacy Policy.


17. Professional Standards & Scope

The School's professional standards, ethical responsibilities, scope of practice and guidance for learners, graduates and practitioners are addressed separately on the School's Professional Standards & Scope page.

Learners are responsible for understanding and observing the standards applicable to their training and any services they may later provide.


18. Complaints and Concerns

Questions, complaints or concerns relating to a programme should be directed to:

The School will consider concerns fairly, respectfully and in accordance with its professional and ethical standards.

Where a formal complaint or dispute requires further consideration, the School may request that the concern be submitted in writing so that the relevant information can be reviewed.


19. Consumer Rights

Nothing in these Terms & Conditions is intended to exclude, limit or waive any right a consumer may have under applicable South African law.

Privacy Policy

This Privacy Policy explains how the School of Applied Metaphysics collects, uses, stores and protects personal information in connection with its educational programmes, professional training, website, enrolment processes and related learner services.


1. Who Is Responsible for Your Personal Information

For the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), the responsible party is:

  • issue certificates and maintain certification records;

  • maintain appropriate business and financial records;
  • comply with legal, accounting or regulatory obligations; and
  • operate, maintain and improve the School's website and services.

Personal information will be collected and used for a specific and lawful purpose related to the School's educational and administrative functions. POPIA requires personal information to be processed in a manner compatible with the purpose for which it was collected.


4. Information Required for Enrolment

Certain information is necessary to process an application, enrol a learner, provide access to a programme, administer payment or maintain required educational records.

Where required information is not provided, the School may be unable to process the application or provide the requested service. Where information is optional, you may choose whether to provide it.


5. Information Shared During Training

Some programmes involve self-inquiry, coaching practice, observation, case studies, practical sessions or other learning activities in which personal information may be shared.

Where you choose to provide personal information as part of your learning experience, it will be used for the purpose of the relevant educational, practical or developmental activity.

Learners are also expected to respect the privacy and confidentiality of information shared by other participants.


6. Assessments, Practical Work and Certification Records

The School may retain records relating to learner participation, assignments, assessments, practical work, observations, completion and certification where these records are required to administer the programme and verify completion.

Where practical training involves another person, learners remain responsible for obtaining any permissions required for the lawful use of personal information, recordings or case material.


7. Service Providers and Sharing of Information

The School may use trusted third-party service providers to support its educational and administrative functions.

Depending on the service involved, these may include providers of:

  • website hosting and website services;
  • enrolment and booking systems;
  • email and communication services;
  • online learning platforms;
  • online meeting or communication platforms;
  • payment processing;
  • accounting and financial administration; and
  • secure data storage.

Only information reasonably required for the relevant service or administrative purpose will be shared.

Where an external service provider processes personal information on behalf of the School, appropriate measures will be taken to protect that information. POPIA requires responsible parties to establish appropriate safeguards and appropriate arrangements with operators handling personal information on their behalf.


8. Payment Information

Where payment is processed through a third-party payment provider, payment information is handled by that provider in accordance with its own privacy and security practices.

The School does not intentionally retain full payment card details.


9. International Processing

Some technology or service providers used by the School may store or process personal information outside South Africa.

Where personal information is transferred across borders, the School will take reasonable steps to ensure that the transfer complies with applicable POPIA requirements. POPIA specifically regulates the transfer of personal information to third parties in foreign countries.


10. Security of Personal Information

The School takes reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access, unlawful processing or disclosure.

Security measures are reviewed and updated where reasonably necessary to address risks associated with the information held.

In the event of a security compromise, the School will take the steps required under applicable law, including POPIA's requirements relating to notification where applicable.


11. Retention of Personal Information

Personal information will be retained only for as long as reasonably necessary for the purpose for which it was collected, to provide the relevant service, to maintain educational and certification records, or where retention is required or permitted by law.

Different categories of information may therefore be retained for different periods.


12. Direct Marketing

The School may communicate with current or former learners about relevant School programmes, educational opportunities or related services where permitted by applicable law.

Where consent is required for direct electronic marketing, appropriate consent will be obtained.

You may request that your information not be used for direct marketing.


13. Your Rights

Subject to applicable law, you may request access to personal information held by the School about you and request correction of information that is inaccurate, incomplete or outdated.

You may also object to certain processing where applicable or raise a concern regarding the handling of your personal information.

Return and Refund Policy

 School of Applied Metaphysics (Pty) Ltd

This policy applies to educational courses, workshops, training programmes and other learning experiences offered by the School of Applied Metaphysics (Pty) Ltd.


1. Enrolment and Payment

Programme fees and payment arrangements are communicated before enrolment.

Where a learner chooses an instalment or payment plan, the agreed payment schedule forms part of the enrolment arrangement.

Enrolment in a programme creates a reserved place within that programme and may involve the allocation of trainer time, learning resources and administrative support.


2. Cancellation Before a Programme Begins

A learner may request cancellation before the programme begins.

Where a refund is requested, the School will consider the request according to the circumstances, the notice provided, the nature of the programme and any reasonable costs or commitments already incurred in preparation for the learner's enrolment.

Any cancellation amount retained by the School will be reasonable in the circumstances and in accordance with applicable South African law.


3. Withdrawal After a Programme Has Begun

Once a programme has commenced, cancellation or withdrawal may affect the amount refundable because access to learning materials, live sessions, trainer time, administration or other programme resources may already have been provided.

Each request will be considered according to the programme, the stage of participation and applicable law.


4. Payment Plans and Instalments

A payment plan does not create a month-to-month cancellation arrangement unless the programme specifically states otherwise.

Where a learner enrols under an agreed payment plan, the plan relates to payment of the agreed programme fee.

If a learner withdraws from a programme, any outstanding payment obligations will be considered together with the applicable cancellation and refund arrangements.


5. Non-Attendance

Non-attendance at a scheduled session does not automatically entitle a learner to a refund.

Where a learner is unable to attend, the School may, where reasonably possible, provide an alternative arrangement depending on the programme format.

The specific programme requirements will apply.


6. Deferral or Transfer

Where circumstances reasonably warrant it, the School may consider a request to defer participation or transfer to a later intake.

Any deferral or transfer is subject to programme availability and the arrangements applicable to that programme.

A transfer is not automatic and must be agreed with the School.


7. Cancellation by the School

The School may need to postpone, reschedule or cancel a programme because of circumstances such as insufficient enrolment, trainer availability, technical difficulties, emergencies or other unforeseen circumstances.

Where this occurs, the School will make reasonable efforts to offer an alternative date, delivery arrangement or other suitable option.

Where the School cancels a programme and cannot reasonably provide an alternative arrangement, any refund due will be handled fairly and in accordance with applicable South African law.


8. Online Programmes and Digital Materials

Where access to online learning materials has already been provided, this may be taken into account when considering a refund or withdrawal request.

Where digital content forms a substantial part of a programme, the applicable programme information will explain any specific access conditions before enrolment.


9. Workshops and Short Courses

Workshops and short courses may have specific cancellation arrangements due to limited places, scheduled trainer time and preparation.

Any programme-specific cancellation terms will be communicated before the booking or enrolment is confirmed.

Where no specific arrangement is stated, requests will be considered under this policy.


10. Refund Processing

Where a refund has been approved, the School will process the refund using the applicable payment method or another agreed method.

The timing of the refund may depend on the payment provider and normal banking processing times.


11. Consumer Rights

Nothing in this policy is intended to exclude, limit or waive any right a consumer may have under applicable South African law.
